# Wellspring: Bill of procedural protections:
|
||||
|
||||
`WS` recognizes, fundamentally, the right to life and as a corollary, it enforces private property sovereignty. In `WS` all actions are permitted unless explicitly disallowed by this constitution or legislation (and all legislation must follow this constitution).
|
||||
|
||||
This bill of procedural protections does not enumerate a fixed list of rights but rather an inexhaustive list of principles which have been discovered to be essential to preserving the sovereignty of the individual before the courts when conducting the common law process. Your right is the right to your own life and property (both cognitive and physical). This document does not grant you rights. Your rights are corollaries of your metaphysical identity as a rational creature. This document merely specifies procedural protections at common law.

Somehow in the present day, there are non-jury trials in the USA for sums exceeding $20, so this must mean that somehow, the 7th amendment wasn't clear enough to people. I'm not sure which part was unclear, but clearly some part of it was certainly unclear.

4. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

||||
5. No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising under the jurisdiction of the `SovWI` courts, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property (both cognitive and physical), without due process of law; nor shall private property be taken for public use except as specified under the `SovWI` law, subject to the published war readiness plan.

6. In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

7. In all `WS` courts, all trials/suits shall proceed according to the common law. In all Suits at common law, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.
|
||||
8. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

||||
9. The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
|
||||
10. The powers not delegated to the `WS` government by this constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
|
||||
11. The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.
|
||||
